Adolph Hitler did not physically participate in the extermination of millions of Jews and other "undesirables". Osama Bin laden did not actively participate in the 9/11 attacks, using the jury for Moussaoui's logic, there lives would be spared. In reality, would we have spared the life of Hitler and will we spare the life of Bin Laden when we catch him?
